Davon ist nicht die Rede. Der verlinkte Artikel spricht ausdrücklich von Verspätungen bei Naturkatastrophen:

5. A force majeure clause would exempt rail companies from having to pay compensation in the event of delays caused by natural catastrophes which they could neither foresee nor prevent.

Im Proposal selbst steht dann dieses:

To limit the restriction of passengers’ rights and ensure legal certainty, the proposal introduces a force majeure clause that applies only in very exceptional situations caused by severe weather conditions and natural disasters.

By introducing a force majeure clause, (...) which exempt operators from paying compensation where delays are caused by extraordinary circumstances.

Ein Ausfall dürfte also weiterhin abgedeckt sein.
